Our attorneys represent leading franchisors in a range of industries including hospitality, real estate brokerage, fast food, tax preparation and business products and services.  The firm currently is national bankruptcy counsel to two of the largest franchisors in the world.

In these economic times, it is not unusual for franchisors to be faced with franchisees in financial crisis. 
When such circumstances arise, our firm is uniquely qualified to assist.

Our attorneys understand that in most instances franchisors have three main concerns when dealing with a franchisee in financial distress:  protecting and preserving the franchisor’s brand, marks, reputation and economic value; collecting fees that have accrued; and preserving the franchise relationship, if appropriate, on a going forward basis.  With these concerns in mind, our firm advises franchisor clients daily on the many options available when faced with a franchisee in financial peril or in any type of bankruptcy proceeding.

Our representation of franchisors runs the gamut from protecting the monetary and intellectual property interests of franchisors to defending franchisors in preference litigation and other affirmative claims sometimes brought by debtors, committees, or trustees.  Our attorneys routinely pursue bankruptcy litigation such as obtaining injunctive relief to compel an infringing franchisee to cease using the intellectual property of the franchisor.  The firm also works with bankrupt franchisees to restructure royalty defaults as part of a confirmed plan of reorganization to keep units “in the system” of a franchisor client.
